General Terms for Rider ("Rider Terms") set out the legal agreement for each passenger ("you, your" or known collectively as "passenger") governing the use of PREHIRE’S owned or licensed software and ordering transportation service.
By accessing and using this app, you accept the following Terms & Conditions and, in addition, if you book and undertake trip rides, the General Terms for Riders.
If you do not agree to these Terms & Conditions, please do not access or use this app.
PREHIRE grants you a non-exclusive licence to access and use the content in this app for your personal purposes. You may not reproduce or distribute any part of the content for commercial purposes.
1.1 To be entirely responsible for and keep secret password used by you. You should change your password if you believe that it's no longer secret
1.2 We will send you (SMS) text messages / and push notifications as part of your use of the services.
1.3 Not to post, distribute or otherwise upload any defamatory, offensive, infringing, obscene, indecent or otherwise unlawful or objectionable material or information or send any chain letters, junk mail, 'spamming' material or any other form of bulk communication.
1.4 Not to threaten, harass, stalk, abuse, disrupt or otherwise violate the rights of others, including Individuals privacy rights.
1.5 Not to make any unauthorised, false or fraudulent trips, reservations or request for services.
1.6 Not to obtain or attempt to obtain unauthorised access in any rider / driver or other customer information on the app.
1.7 To not, cause or permit anything to be done that may infringe, damage or interfere with any intellectual property rights of PREHIRE or any of our associated companies or third parties.
1.8 Not to do anything that is otherwise unlawful, or which may cause any liability for us.
2.1 Send you warning via email / SMS.
2.2 Suspend or restrict your access to the app.
2.3 Permanently prohibit you from accessing the app.
2.4 Block device using your IP address from accessing the app.
2.5 Suspend and / or terminate your user account.
3.1 If your conduct on our app causes us, or any associated company loss, damage or other costs, you shall be responsible for reimbursing these costs.
3.2 You always undertake to fully and effectively indemnify and to keep PREHIRE indemnified against all actions, proceedings, costs, claims, demands, liabilities and expenses whatsoever (including legal and other fees and disbursements) sustained, incurred or paid by PREHIRE in respect of:
3.2.1 Any information, data or material produced, stored, transmitted or downloaded by you when using this app.
3.2.2 Any breach by you of these terms and conditions or of any law, code or regulation relating to this app.
4.1 PREHIRE do not make any promise that access to the service will be uninterrupted or error free. PREHIRE makes no representation, warranty or guarantee regarding the reliability, timeliness, suitability or quality of the service. To the maximum extent permitted under applicable law, you agree to accept sole responsibility for any risk arising out of your use of the service or any ride contracted for through the service.
4.2 PREHIRE excludes all warranties, express or implied relating to this app. This includes, but is not limited to, any implied warranty that the information it contains is accurate or up-to-date or is suitable for any purpose.
4.3 PREHIRE shall not be liable for any loss or damage suffered as the result of the use of this app.
4.4 There may be links to 3rd party websites or apps from the PREHIRE app; however, these other websites and apps are not controlled by PREHIRE and we are not responsible for any content contained or any loss suffered by you in relation to your use of such websites and apps. You waive all claims against PREHIRE regarding the inclusion of links to outside websites and apps or your use of those websites and apps.
4.5 In the event of any claim against PREHIRE arising out of its performance of hire, the company’s liability shall be limited to a refund not exceeding the total fare amount of the ride. Any other payments will be entirely at the discretion of the company.
5.1 PREHIRE will accept trip requests via the Rider’s App and then prompt the nearest driver available in your area. These trip requests will also be offered to other relevant drivers when the nearest available driver in your area is not able to fulfil your trip request.
5.2 Once an individual driver accepts your trip request, you will enter into separate agreement with the driver for the provision of the ride on such Terms & Conditions as you agree with the driver to provide the ride.
5.3 You acknowledge that PREHIRE only provides the Software Services to facilitate the making of such subsequent contracts between you, as a rider and the driver providing the rides. PREHIRE does not guarantee that the use of the Software will result in you receiving the transportation services.
5.4 You may Cancel your booked trip any time before you begin your ride by informing the Driver through the cancellation functionality available in the Rider’s App.
However, PREHIRE encourages you to make cancellation at earliest, as this helps PREHIRE in allocating other /relevant trip request to Driver.
5.4.1 Driver may Terminate your booked trip any time before proceeding with your ride by informing you through the termination functionality available in the Driver’s App..
5.4.2 You acknowledge that No Show fee will apply, if you failed to meet your Driver at your pick-up location in 5 minutes from the time your Driver has arrived, unless you have contacted your driver to make prior arrangement,Driver may Terminate your ride, PREHIRE will charge you the No Show Fee (minimum ride fare) on behalf of the Driver.
5.5 PREHIRE will monitor the number and frequency of booked trips you cancel and reserves the right to suspend or terminate your access to the Software Services where you repeatedly, or consistently, cancel booked trips.
Earn incentive through referrals, when you invite people to use Rider’s App and get them to sign up using your referral code.
Once your invitee completes the first trip, your incentive will be added to your account and will appear in your wallet.
7.1 PREHIRE expects a high standard of service from all partner Drivers. It is vital for its integrity and reputation, PREHIRE monitors Driver’s activity on the Software in providing trip rides.
All partner Drivers are licensed by the local licensing authority, fully CRB checked and they undergo verification & training process before being affiliated with PREHIRE to provide transportation services to you through the Rider’s App.
7.2 Driver will convey you from your point of collection to your point of destination in a reasonably direct and efficient manner, subject to appropriate unforeseen circumstances (such as a mechanical breakdown) or civil emergencies) may result in your driver being unable to complete your ride.
7.3 You acknowledge that whilst undertaking the trip ride:
7.3.1 You agree that, you will treat your driver with respect, courtesy and decency – as you would expect to be treated as a rider.
7.3.2 Your driver may take any reasonable route to your destination, PREHIRE does not set any route restrictions, you may advise your driver to use your preferred route at his discretion.
7.3.3 You will not consume or carry drugs or alcohol in the vehicle, incite or encourage violence, racism or discrimination in any form.
7.3.4 You acknowledge that PREHIRE has no control over the ride. PREHIRE shall have no responsibility or liability with respect to how (or whether) the Driver provides your trip, including delays or damage to persons or property.
8.1 Before boarding the car you must verify that you are being collected by the driver shown in the Rider’s App (or that the driver has expressly confirmed his identity).
8.2 Failure to verify your Driver before beginning your ride may result in you undertaking the ride with the other (Unknow) Driver, in such case your booked Driver will Terminate the ride on the Driver’s App, after waiting 5 minutes at your point of Pick-up, PREHIRE shall charge you the No Show Fee (minimum ride fare) on behalf of the Driver.
9.1 The estimated fare will be provided to you before allocating trip booking to the relevant driver.
9.2 The actual fare for the trip provided to you will be determined by the Software after the trip is completed, having regards to the actual trip distance, duration, peak-pricing, any promotional value or applicable surcharge. It is therefore possible that the actual fare may be less or more than the estimated fare.
9.3 Trip fare may still be affected by other factors. Airport fee, parking or toll charge may also be added to your final trip price.
9.4 You agree that PREHIRE is entitled to charge you the fare amount on behalf of driver who has provided you the transportation through the Rider’s App.
10.1 Once your trip has ended, Software calculate the actual trip fare on the Driver’s App with the payment options (Cash / Card) to charge the fare amount. You will also be notified on the Rider’s App that your trip has ended and waiting for payment.
10.2 You may advise driver your payment preference to complete the trip, pay the fare amount in cash if you prefer to avoid paying by card or advise the driver to charge your card.
PREHIRE shall invoice you on behalf of the Driver and charge your nominated credit or debit card for the fare amount.
10.3 PREHIRE will then create a receipt on your behalf setting out the trip details, route, distance, duration and other relevant information relating to that particular trip.
10.4 The receipt for each trip will be accessible to you on the Rider’s App. It will also be forwarded to the Driver.
10.5 You acknowledge that you are obliged to pay the due fare amount in cash to your driver, if your card payment failed because your debit or credit card is cancelled or is unsuccessful for the reasons not attributable to PREHIRE. .
10.6 In the event that you dispute the amount of fare paid by you, PREHIRE may withhold the disputed amounts until the dispute has been solved.
10.7 If due to your fault, PREHIRE is unsuccessful in charging the fare amount or any other due amount to your debit or credit card, PREHIRE will inform you and may suspend or temporarily disable your user account to access the Rider’s App. PREHIRE shall be under no obligation to provide you the services whilst the due amount is unpaid.
11.1 Without affecting any of PREHIRE’S other rights under these Rider Terms, where PREHIRE has reasonable grounds to suspect that you have committed, attempted to commit, aided or abetted a crime, it shall take all steps it deems necessary in the circumstances, including reporting your misconduct to the appropriate authorities. You acknowledge that this may include reporting your conduct to the Police, or any other relevant authorities and providing that agency with your details and /or any relevant information we hold about the circumstances at issue. Where the misconduct relates to fraud, including fraudulent booking trip rides, PREHIRE reserves the right to withhold any payments payable to you because of undertaking trip rides.
