Driver Terms

Agreement

General Terms for Driver ("Driver Terms") set out the legal agreement for each transportation provider ("you, your" or known collectively as "Drivers") governing the use of PREHIRE'S owned or licensed software and provision of Riders trips.

By using this app, you accept the following Terms & Conditions and, in addition, if you accept a trip booking allocation from PREHIRE and provide the transportation to riders, the General Terms for Drivers.

Licence

PREHIRE grants you a non-exclusive licence to access and use the content in this app for your personal purposes. You may not reproduce or distribute any part of the content for commercial purposes.

1. When Using This App You Agree:

1.1   To be entirely responsible for and keep secret password used by you. You should change your password if you believe it's no longer secret.

1.2   We will send you (SMS) text messages / and push notifications as part of your use of the services.

1.3   Not to post, distribute or otherwise upload any defamatory, offensive, infringing, obscene, indecent or otherwise unlawful or objectionable material or information or send any chain letters, junk mail, ‘spamming’ material or any other form of bulk communication.

1.4   Not to threaten, harass, stalk, abuse, disrupt or otherwise violate the rights of others, including Individuals privacy rights.

1.5   Not to make any unauthorised, false or fraudulent trips, reservations or request for services.

1.6   Not to obtain or attempt to obtain unauthorised access to any rider or other customer information on the app.

1.7   To not do, cause or permit anything to be done that may infringe, damage or interfere with any intellectual property rights of PREHIRE or any of our associated companies or third parties.

1.8  Not to do anything that is otherwise unlawful, or which may cause any liability for us.

2. Breach of Terms

If we consider that you have breached any of these terms of use or have otherwise demonstrated inappropriate conduct when using this app, we reserve the right to:

2.1   Send you warning via email / SMS.

2.2   Suspend or restrict your access to the app.

2.3   Permanently prohibit you from accessing the app.

2.4   Block device using your IP address from accessing the app.

2.5  Suspend and / or terminate your user account.

3. Indemnity

3.1   If your conduct on our app causes us, or any associated company loss, damage or other costs, you shall be responsible for reimbursing these costs.

3.2   You always undertake to fully and effectively indemnify and to keep PREHIRE indemnified against all actions, proceedings, costs, claims, demands, liabilities and expenses whatsoever (including legal and other fees and disbursements) sustained, incurred or paid by PREHIRE in respect of:

 3.2.1   Any information, data or material produced, stored, transmitted or downloaded by you when using this app.

 3.2.2   Any breach by you of these terms and conditions or of any law, code or regulation relating to this app.

3.3   We may revise these terms of use from time-to-time.

3.4   Revised terms of use will apply to the use of this app from the date of the publication of revised terms of use. Please check this page regularly to make sure that you are familiar with the current version.

4. Liability

4.1   PREHIRE excludes all warranties, express or implied relating to this app. This includes, but is not limited to, any implied warranty that the information it contains is accurate or up-to-date or is suitable for any purpose.

4.2   PREHIRE shall not be liable for any loss or damage suffered as the result of the use of this app.

4.3   There may be links to 3rd party websites or apps from the PREHIRE Driver's app; however, these other websites and apps are not controlled by PREHIRE and we are not responsible for any content contained or any loss suffered by you in relation to your use of such websites and apps. You waive all claims against PREHIRE regarding the inclusion of links to outside websites and app or your use of those websites and apps.

4.4   In the event of any claim against PREHIRE arising out of its performance of hire, the company’s liability shall be limited to a refund not exceeding the total fare amount of the ride. Any other payments will be entirely at the discretion of the company.

5. General Terms for Driver

5.1   PREHIRE will accept rider requests for the trips and then prompt you via the Driver’s App if a relevant rider booking has been generated in your area, when you are available to accept rider’s request. These trip bookings will not be exclusive to you, and will also be offered to other drivers when you are not available or if you decline to accept.

5.2   Each trip request you accept to fulfil through the PREHIRE Driver’s App will constitute a separate service agreement between you and the applicable rider, with such agreement coming into force from the time you agree to undertake the allocated trip booking made available to you. You acknowledge that, PREHIRE only provides the Software Service to facilitate the making of such subsequent contracts between you, as a Driver, and the Rider requesting a trip.

5.3   PREHIRE does not guarantee that the use of the Software will result in you receiving the booking allocations for trips.

5.4   You are not obliged to accept any trip booking allocations, however PREHIRE encourages you to keep your profile up to date (Logged Off) when you are not available, as this helps PREHIRE to allocate the trip to the relevant driver.

5.5   You may cancel an allocated trip any time before you begin the trip by informing the rider through the Driver’s App. However, PREHIRE will monitor the number and frequency of allocated trips you cancel and reserves the right to suspend or terminate your access to the Software Services where you repeatedly, or consistently, cancel allocated trips.

5.6   As part of the Software Services, riders may provide feedback on you and your provision of the trips in the form of ratings. These ratings are made available to prospective riders as part of PREHIRE rider application. You should contact PREHIRE if you have any issues with the ratings that you are provided with. PREHIRE shall provide you with assistance on the Software Services including steps to consider taking to help you maintain good rider’s feedback and ratings.

6. Your Contract with Riders

6.1   PREHIRE expects a high standard of service from drivers. In order to maintain its integrity and reputation, PREHIRE monitors your activity on the Software in providing trip ride’s, we expect that you will:

6.2   Convey the riders from their collection point to their point of destination in a reasonably direct and efficient manner, subject to appropriate unforeseen circumstances (such as a mechanical breakdown).

6.3   Ensure to be medically fit to operate a motor vehicle, including being free from the influence of alcohol or drugs;

6.4   Not engage in reckless behaviour while driving or drive unsafely, including by operating a vehicle that is unsafe or illegal to drive or allowing a third party to operate the vehicle.

6.5   Act in a professional manner in accordance with the business ethics applicable to providing rider transportation and endeavour to perform the rider’s request in the best interest of the rider;

6.6   Not carry weapons (or permit weapons in your vehicle), use or encourage violence, racism or discrimination in any form .

6.7   Have and maintain, valid hire and reward insurance, liability insurance (if applicable) and any other insurance that is required in the applicable jurisdiction for providing rider transportation services.

6.8   You acknowledge that PREHIRE has no control over the rider. PREHIRE shall have no responsibility or liability with respect to how (or whether) the rider uses your trips, including delays or damage to person or property.

7. Verifying Rider

7.1   Before starting the trip, you must verify that you are providing the trip to the rider shown in the Driver’s App (or that the rider has expressly confirmed that they allow the rider to ride under their account.

7.2   Failure to verify the rider may result in the fare being charged to the customer who has not been provided or approved the trip, PREHIRE shall reimburse the customer for the fare amount paid, in such case, you shall not be entitled to receive the fare for the relevant trip from PREHIRE. For the avoidance of doubt, the commission for that trip will still be payable.

8. Fares

8.1   The estimated fare will be provided to the rider before allocating trip booking to the relevant driver.

8.2   The actual fare for the trip provided by you will be determined by the Software after the trip is completed, having regards to the actual trip distance, duration and any peak pricing. It is therefore possible that the actual fare may be less or more than the estimated fare.

8.3   You agree that PREHIRE is entitled to charge a fare on your behalf for each completed trip you provide to a rider through the Driver’s App.

8.4   You may complete a trip by any reasonable route, PREHIRE does not set any route restrictions. However, we expect that you will provide the trip in accordance with clause 6.1 and otherwise in accordance with these Driver Terms. Where PREHIRE considers that any trip you have completed did not comply with these Driver’s Terms, PREHIRE reserves the right to pay any refunds or compensation offered by PREHIRE to the affected Rider(s) against your portion of the fare paid by that rider.

9. Payment

9.1   Once you end the trip on the Driver’s App, Software calculate the actual trip fare on the driver’s app with the payment options (Cash / Card) to charge for the ride. The rider is also notified on the rider’s app that the trip has been completed and waiting for payment. You may ask rider’s preferred method of payment before completing the ride, for cash payment take the fare amount in cash and tap (Cash) button on the Driver’s App, for card payment tap the (Card) button on the Driver’s App, PREHIRE shall invoice the rider and charge the rider’s nominated credit or debit card for the amount of the fare, PREHIRE will then create a receipt on your behalf setting out the trip details, route, distance and duration and other relevant information relating to that particular trip. You must not ask for or take cash payment if the rider prefers to pay by card, unless or otherwise, the card payment functionality malfunction.

9.2   The actual fare for the trip provided by you will be determined by the Software after the trip is completed, having regards to the actual trip distance, duration, peak-pricing, any promotional value or applicable surcharge. It is therefore possible that the actual fare may be less or more than the estimated fare.

9.3   Trip fare may still be affected by other factors. Airport fee, parking or toll charge may also be added to final trip price. It is therefore your responsibility to add applicable extras.

9.4   PREHIRE shall transfer the first (Driver’s Payment) into your bank account 21 days after completing the first ride and once a week thereafter. Fare amounts collected as your trip’s fares less the applicable commission.

9.5   In the event that you dispute the amount of fares paid to you, PREHIRE may withhold the disputed amounts until the dispute has been solved.

9.6   You acknowledge that PREHIRE shall not be obliged to pay you the fare due from a rider if the rider’s payment failed because the rider’s credit card is cancelled or is unsuccessful for reasons not attributable to PREHIRE.

9.7   Your PREHIRE payment reports will be made available to you in the Driver’s App on a weekly basis. The reports will show the fares collected in relation to your trips, as well as the amounts of the commission withheld by PREHIRE.

9.8   If due to your fault, PREHIRE is unsuccessful in charging the fare amount or any other due amount to your debit or credit card, PREHIRE will inform you and may suspend or temporarily disable your account to access the Driver’s App.
PREHIRE shall be under no obligation to allocate trip bookings to you while the due amount is unpaid.

10. Reporting Misconduct

10.1   Without affecting any of PREHIRE’S other rights under these Driver Terms, where PREHIRE has reasonable grounds to suspect that you have committed, attempted to commit, aided or abetted a crime, it shall take all steps it deems necessary in the circumstances, including reporting your misconduct to the appropriate authorities. You acknowledge that this may include reporting your conduct to the Police, Transport for London or any other relevant licensing authority and providing that agency with your details and /or any relevant information we hold about the circumstances at issue. Where the misconduct relates to fraud, including fraudulent documents, PREHIRE reserves the right to withhold any payments payable to you because of fraudulently performing rides.
